·  What is the Certificate of Origin?

The Certificate of Origin (CoO) is a document to certify the place of growth, production or manufacture of goods. It is required when exporting to specific countries, when requested by the consignee for customs clearance, or when it's stipulated in a letter of credit. The document is completed by the exporter or its agent and certified by an organization in the country of the exporter, such as a chamber of commerce.

The “origin” does not refer to the country where the goods were shipped from but to the country where they were produced. For products manufactured in two or more countries, origin is obtained in the country where the last substantial economically justified processing is carried out. An often used practice is that if more than 50% of the cost of producing the goods originates from one country, the “national content” is more than 50%, then, that country is acceptable as the country of origin.

·  Who determines Whether the CoO is Required?

Either the customs authority of the importing country or a financial institution. The exporter and/or their freight forwarder or customs house broker will know if a CoO is required when importing into a foreign country

·  What is Ordinary Certificates of Origin (Non-preferential)

KNCCI only issues the ordinary Certificate of Origin which is non-preferential. These certificates of origin see that goods do not benefit from any preferential treatment and do not emanate from a particular bilateral or multilateral free trade agreement.

·  What is Preferential Certificate of Origin?

A preferential certificate of origin is a document attesting that goods in a particular shipment are of a certain origin under the definitions of a particular bilateral or multilateral free trade agreement (FTA). This certificate is required by a country's customs authority in deciding whether the imports should benefit from preferential treatment in accordance with special trading areas or customs unions. Kenya has the following preferential certificates;

  • COMESA         Common Market for Eastern and Southern Africa
  • EAC                    East Africa Community
  • GSP                Generalised System of Preferences
  • AGOA            African Growth and Opportunity Act
  • EUR 1             Export Certificate for the European Union
  • ACP               African Caribbean and Pacific countries
  • EU                 European Union

These CoOs are issued by KRA at Nairobi, Mombasa, Kisumu, Nakuru and Eldoret stations\

·  How to Apply for Ordinary Certificate of Origin?

Since April 2016, KNCCI has automated issuance of Ordinary Certificate of Origin. Previously, KNCCI was issuing the CoO Manually.
